By accessing or using SmartFlow360 ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Platform.
These Terms constitute a legally binding agreement between you ("Client" or "User") and SmartFlow360, operated by Wagner Garcia and Thiago Neves, based in Queensland, Australia.
SmartFlow360 provides the following services:
We reserve the right to modify, suspend, or discontinue any feature with reasonable notice.
You are responsible for maintaining the confidentiality of your credentials, all activity under your account, ensuring content you provide does not infringe third-party rights, and complying with all applicable platform policies (Meta, Google, etc.) when authorising SmartFlow360 to manage your accounts.
Notify us immediately at hello@smartflow360.io if you become aware of any unauthorised use of your account.
Content created by SmartFlow360 on your behalf is owned by you upon full payment of applicable fees. The SmartFlow360 platform, software, branding, and underlying systems remain the exclusive property of SmartFlow360.
You grant SmartFlow360 a non-exclusive licence to use your brand assets and account data solely for the purpose of delivering the agreed services.
To the maximum extent permitted by law, SmartFlow360 is not liable for any indirect, incidental, or consequential loss arising from use of the Platform. We do not guarantee specific advertising results, reach, engagement, or return on investment.
Our total aggregate liability for any claim shall not exceed the total fees paid by you in the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms excludes any right or remedy you may have under the Australian Consumer Law (ACL), including any consumer guarantee that cannot be excluded by law.
These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia. Both parties submit to the exclusive jurisdiction of the courts of Queensland for the resolution of any disputes.
Before initiating formal proceedings, both parties agree to attempt resolution in good faith through direct negotiation for a period of 14 days from when the dispute is first raised in writing.
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised date. We will provide at least 14 days notice of material changes via email to registered account holders.
